These Terms of Service (“Terms”) govern your access to and use of the NourishWorth platform, including our website at https://nourishworth.com and our mobile applications (together, the “Service”), operated by NOURISHWORTH.COM LTD (“NourishWorth”, “we”, “us”, or “our”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. About NourishWorth

NourishWorth is a personalised food platform that helps you discover, understand, plan, and track food decisions. The Service currently includes the following features:

• Food DNA: a personalised food profile built from your preferences, dietary requirements, and food interactions.
• Food and restaurant recommendations: personalised suggestions based on your Food DNA and location.
• Meal logging and nutrition tracking: tools to log foods and drinks and view nutrition summaries.
• Hydration tracking: tools to log water and beverage consumption.
• Food and drink scanning: camera and barcode scanning to identify food items.
• Restaurant discovery: location-based restaurant and food venue discovery.
• Recipe discovery: browsing and saving recipes from creators on the platform.
• Grocery and shopping: shopping list management and supermarket product discovery where provider coverage is available in your area.
• Meal planning: AI-assisted meal plan generation and management.

Feature availability may vary by country or region depending on provider coverage. We do not guarantee that any specific feature will remain available or that coverage will extend to all markets. We may modify, improve, or discontinue features at any time.

2. Your Account

To use most features of the Service, you must create an account. You must be at least 16 years old to create or use a NourishWorth account. By creating an account, you confirm that you meet this minimum age requirement.

You agree to:

• Provide accurate, current, and complete information when registering.
• Keep your account information up to date.
• Keep your password and account credentials secure and confidential. You are responsible for all activity that occurs under your account.
• Notify us promptly at support@nourishworth.com if you become aware of any unauthorised use of your account.

You may not create an account on behalf of another person without their authorisation, or impersonate any person or entity.

3. Nutrition and Wellness Information — Important Disclaimer

You should always seek the advice of a qualified healthcare professional with any questions you have regarding a medical condition, dietary requirements, or health goals. Never disregard professional medical advice or delay seeking it because of something you have read or seen on NourishWorth.

You acknowledge and accept that:

• Nutrition information displayed on the Service may be incomplete, estimated, or sourced from third-party databases that may contain errors.
• Scanner recognition results are probabilistic and may be uncertain or incorrect.
• Restaurant and menu information is sourced from third parties and may not reflect current menus, ingredients, or preparation methods.
• Nutrition recommendations are based on general targets and your logged data — they are not personalised medical prescriptions.
• Where nutrition data is unavailable, it is recorded as unknown rather than as zero. NourishWorth does not fabricate nutrition values.
• AI-generated meal plans and food suggestions are based on your logged preferences and general nutritional principles — they are not medical dietary prescriptions.

4. Allergy and Dietary Safety — Important Disclaimer

NourishWorth does not guarantee that:

• Any food or dish is free from a specific allergen.
• Any restaurant or food venue is safe from cross-contamination.
• Third-party menu or ingredient information is accurate or current.
• A dish is halal, kosher, vegan, vegetarian, gluten-free, or free from any other specific ingredient solely because an external data source or NourishWorth recommendation indicates it.

Where dietary or allergen information is unknown or unverified, NourishWorth treats it as unknown — not as safe. You should never rely solely on NourishWorth for allergy or dietary safety decisions.

5. Third-Party Services and Content

The Service integrates with or displays content from third-party services, including restaurants, food merchants, supermarkets, map and place data providers, delivery services, payment services, recipe creators, and external websites. These third-party services operate under their own terms and privacy policies, which we encourage you to review.

NourishWorth is not responsible for the accuracy, completeness, or availability of third-party content, or for the practices of third-party service providers. Links to external websites do not constitute endorsement.

Restaurant, menu, and food venue information is sourced from third-party data providers and may not reflect current offerings, prices, opening hours, or availability. Always confirm details directly with the relevant business.

6. Your Content

You retain ownership of content you create and submit to the Service, such as food logs, personal notes, and profile information (“Your Content”). By submitting Your Content, you grant NourishWorth a limited, non-exclusive, royalty-free licence to host, process, display, and distribute Your Content within the Service as necessary to operate and provide the Service to you.

You are responsible for ensuring that Your Content does not infringe the rights of any third party and complies with applicable law.

6.1 Creator Content

Where the Service allows creators to submit recipes, images, descriptions, or other content, that content remains the property of its respective creator. Creators are responsible for ensuring they have appropriate rights to any content they submit. NourishWorth cannot guarantee that creator-submitted content is accurate, complete, or free from error. Intellectual property rights of third parties must be respected.

Creator monetisation, royalty, or payment terms are not yet finalised and will be addressed in a separate creator agreement when that functionality is available.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Commit fraud or engage in deceptive practices.
• Impersonate any person or entity or misrepresent your affiliation.
• Attempt to gain unauthorised access to the Service, our systems, or other users' accounts.
• Transmit malware, viruses, or other harmful code.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to compromise the security of the Service or circumvent security measures.
• Infringe the intellectual property rights of NourishWorth or any third party.
• Misuse or unauthorisedly access other users' personal information.
• Use the Service for any unlawful, abusive, or harmful purpose.
• Use automated tools to scrape, crawl, or extract data from the Service without our prior written consent.

8. Intellectual Property

The NourishWorth name, logo, brand, software, platform technology, interface design, and original content are the property of NOURISHWORTH.COM LTD or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand without our prior written consent.

Third-party content, trademarks, and intellectual property displayed on the Service remain the property of their respective owners.

9. Account Suspension and Termination

We may suspend or terminate your account or access to the Service if we reasonably believe you have materially breached these Terms, engaged in fraud or abuse, posed a security risk, or where required by applicable law. We will endeavour to provide reasonable notice where practicable, except where immediate action is necessary to protect the Service or other users.

You may close your account at any time using the in-app account deletion feature in your Profile, or by contacting us at support@nourishworth.com.

10. Service Availability and Changes

We do not guarantee that the Service will be available at all times or without interruption. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Certain features may depend on third-party services whose availability we cannot guarantee.

We may modify, improve, or discontinue features of the Service at any time. Where we make material changes that affect your use of the Service, we will endeavour to provide reasonable notice.

11. Disclaimers and Limitation of Liability

The Service is provided on an “as is” and “as available” basis. To the extent permitted by applicable law, NourishWorth excludes all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms limits or excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

Subject to the above, to the extent permitted by applicable law, NourishWorth will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales.

Nothing in these Terms affects any mandatory rights you have as a consumer under the laws of your country of residence that cannot be excluded or limited by contract. If you are a consumer resident in a jurisdiction that provides you with additional mandatory protections, those protections continue to apply.

Subject to the above, any disputes arising under these Terms will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, by sending you a notification. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
